As long as you stick to the truth or well based speculations for which you give a solid rationale, I see no harm. The truth is never libelous. The truth is also that the SEC has suspended this issue for what they considered at least "irregularities". I am not even sure how one manages and get a private placement organized when still under investigation by the SEC. Typically, you have to at least register the private placement in five states, that requires pre registration (NY one of them), and the issuer has to show a "clear" bill of juris prudence, I think that would include no outstanding unsettled issues with the SEC. But, not being a lawyer, I do not know what way there is around it. I know that when I got my "issuer dealer" from the state of NH (only good for a specific private placement I am involved with), they checked to make sure all is "kosher" with me personally.
