Dear Gary: As you said in part in your # 2069:: "I am not an attorney_______". However Gary, you are the :"Lead Agency", the :"Publisher" on this MIDL Board. As such you have, in your ever faithful manner, unintentionally placed me in an embarrassment,. by bringing up the possibility of my suing the Liquidation Trust. My legal brief presented in #2049 lays out the legal basis/appeal to JOIN WITH----NOT SUE THE LIQUIDATION TRUST.. In legal circles, a brief would be passed around and examined for its merits. If judged valid by peers the brief would be expanded, modified, polished. The purpose of my brief was to GIVE HOPE AND ENCOURAGEMENT TO THOSE WHO SWITCH TO WARRANTS. 1. As you said Gary: "but I have been told numerous times today that when a shareholder sells they settle their complaint and thus have to make a case against said fraudulent person or persons". May I say: even though selling establishes a detachment there may still be valid grounds for recourse or participation through the Trust. 2. One major point of my brief is that the act of selling commons and buying warrants in an effort to salvage lost profits does not: DIVORCED ONE FROM THE INVESTMENT BUT ESTABLISHES A CONTINUITY . 3. As you may be aware, the Law cannot be specific in all areas. This is why we have determinations by the JUDGE. 4.. As well as an attorney knows a judge, he cannot always know the end result of an action.before that judge. Also some judges have poor knowledge of the law in depth. The attorney must have researched the laws, torts, histories, legal presidents before presenting his case and further arguement I should keep my experience to myself or restricted my brief to the non-family legal circles in which I am involved.
