anyone,

Standard policy is that a publicly traded stock company makes all information public. If it is a private placement they intend to make, the information about that private placement is made public. The issue about whether the company should make information available to the public about which company they are intending to "reverse merge" with is a business decision not, IMO, a legal decision......as long as they make it (any information) public. IMO, however, an 8K is needed because the substance of the letter implies a material change from their last 8K.
