They said all the right things which the CC confirmed. The only thing lacking was something firm! Only a total fuck up would go to the most important day in the Q and not give anything concrete!
Heck the best deal, well in the long run the best deal is not always the right deal. I think they teach you that as rule #3 in basic business classes.

I don't think that it is desperation.

I do think that it is a matter of facing the fact that a tiny company like Vivus can not compete with the likes of Pfizer. Vivus will survive--either it will be bought out or it will recover from the Viagra crisis. All us "speculators" demand immediate results. Its going to take at least one more quarter to know what the future will hold.
