Thanks for your response. My understanding is, the judge stop short of enjoining Aquarius because CDN did not file some direction evidences.

For some reasons, this has been delaying for quite a while. It could be that CDN wanted to use "indirect copying" to enjoin Aquarius because that would be easier to prove and broader to expand. However, the judge asked for more direct evidence like "substantial similarity," which will take more time & effort to prove. Because AVNT can hire some other experts to argue the validity.

Anyway, AVNT's future is still clouded, and I think that this does give a very bad example. It's just like so many penny stock scams out there and will never be caught with justice, IMHO.
