Theres much posted on the subject around SI bob, but i believe basically it's illegal in U.S. to sell short on any stock which trades on the bulletin board. Some Canadien Brokerage houses have been accepting these short purchases where somehow it's legal there. I also read a report on SI where a few of the transfer Agents or Clearing houses(not sure which) have been caught illegally loaning certain companies share certificates out to short sellers when they were supposed to be holding them in safe keeping for brokerage houses.
This is why the battle cry of many bb threads is call in all your stock certificates to squeeze the shorts. Don't know if it works or not.
