I was under the impression that the SEC didn't comment on ongoing investigations:

"News from our office will be somewhat negative for the company," says Kathryn Addleman of the Denver SEC office.

I, for one, would love to see a charge, any charge, from the SEC so that the courts could ferret out their investigative and reporting policies.
