They did NOT say "that a government agency DID try to..."

There is a difference and it does matter.


Try again.

To say "We're (We ARE) disappointed that a government agency would try" means, using other words, that that they did try according to Microsoft. Otherwise, why would they say that they are they disappointed? Over nothing?

No, by construction, "would" is used here as the past tense of "will", NOT future. (If it were conjectural then the sentence would have been "We WOULD be disappointed".)

Therefore , the only correct reading of the statement is that Microsoft is presently disappointed that the Clinton administration did try to influence foreign governments against it, an American company.

Forget the parsing and try thinking. Just who do you think tipped off those senators anyway? By its statement and actions, Microsoft has clearly and unambiguously confirmed that it thinks that the Clinton administration did try to enlist foreign governments to attack it.
