Well it is legal with the possible exception of Board members violating their fiduciary duty. But I can guarantee you it will keep occurring since the spineless FASB backed down, and most investors are not bright enough to figure out what is going on. Well, maybe there are one or two, like the Wisconsin Pension Board. Until investors start slamming companies that do this .....
