I think its the strength of the xoma patents that brought the deal it did.
Basically incy gets almost nothing if bpi doesnt pan out. If it does pan out incy will share in the profits that they otherwise couldnt get.
Xoma locks out the competition for virtually no risk.
Xoma also gets freedom of expression and development without apparent threat of lawsuit. Still havent read the edgar, but I will.
Oh yeah, no overhang now from potential bpi partners.
Good deal xoma. What I wanted all along. Good timing too, pre-september
