The hearing, scheduled to last two weeks, will focus on a series of columns Collins wrote in the North Shore News and the now-defunct Daily Victorian, which complainant Harry Abrams says created hatred toward a number of minorities. The difference between the earlier complaint and the current one is that the first one, filed by the Canadian Jewish Congress, involved a single article while the Abrams complaint relies on several Collins' articles. The B.C. Human Rights Commission is supporting Abrams' position that his complaint has merit and should be upheld. "Hate speech poses a serious threat to individuals and society by undermining the dignity, self-worth and sense of security of target groups," deputy chief commissioner Harinder Mahil said. "Hate speech undermines the value of equality, tolerance and respect for the inherent dignity of persons that our human-rights law is designed to uphold." Collins and The North Shore Free Press Ltd. have served notice that as a part of the proceedings, they intend to challenge the constitutionality of section 7 of the B.C. Human Rights Code, which prohibits discriminatory and hate publications. The constitutionality of part of section 7 was upheld in the November, 1997 decision in the Collins case, even though Collins won. In that decision, tribunal chair Nitya Iyer found the column in question, which was about the movie Schindler's List, was anti-Semitic and "likely to make it more acceptable for others to express hatred or contempt against Jewish people " But even though she called the column "nasty, deliberately provocative and insulting," she also ruled it was not sufficiently vitriolic to warrant action under the B.C. Human Rights Code. Still, the last ruling upset all parties. The B.C. Civil Liberties Association called it a threat to freedom of speech. Collins, who retired from the paper last September, could not be reached for comment on Sunday. Abrams, who is filing the complaint as an individual though he is the B.C. representative of B'nai B'rith Canada, said the series of columns his complaint is about could cause hatred against groups including Jews, Sikhs, Iranians, Chinese and Japanese.
