from what I have seen, trader status = someone who goes in and out all the time for a quick buck. Any hint that there is a buy and hold position or two can negate that and turn one back into a scheduleD/investor. A properly prepared tax return with a lot of supporting schedules and supplemental information included may help prevent an audit; on the other hand it may confuse them more and trigger one....

I suppose that as the internet allows for the number of daytraders to grow that the issue will be better defined over time.

Hopefully as I make my millions and try trader status on my return, when they audit me I'll be a test case to help one and all HAHAHAHAHAHAA that's the funniest thing after expiration cleaned me out!
