Art, I think that one thing that is important to realize, regarding the buyback money is that 3 million of the 5 million total, was used to repurchase Bob Mullers shares which we were contractually obligated to consumate if Bob exercised his Put option (which he did). (see the 8-K on the Muller deal for details) Whether we had a buyback in place or not when those Puts were exercised is irrelevant, since we had to come up with the 3 million cash per the purchase agreement. So when talking about the buyback $$ used, the amount in question is about 1.7 million per the annual report.

I don't like the Convertible preferred either, but lets suppose that we had instead issued debt at perhaps 20% interest. What would the cost of the series C money have been to this time if we had gone that route and would we really be better off since we would be obligated to service that debt? I don't like large negative cash flows, and servicing a lot of high interest debt is just that. There are considerable risks in building on large negative cash flows, especially with startup companies as we were when the series C was issued. The best option in my opinion would be to just sell shares, but at this price level I can sure see why Murphy would not want to take that option. It's my guess, but I am thinking that he has been betting on our price being up at the time of the Preferred conversion, which if this happens we would come out pretty well . Just my input and opinions.

Art, Our MM OLIE has been acting differently the past couple days.
In the recent past he was agressive about moving his shares. In
other words when another MM joined him at the ASK he would move us
down, in other words he made sure that he was the only player on the
ASK. This AM we opened at 1.688 with SHWD on the ASK and OLIE
remained at 1.71 and did not move down. Currently another MM WIEN
has joined OLIE at the ASK and OLIE has not made any move down to
undercut WIEN. Add to this the fact that OLIE has also gone to the
bid side and has been there since yesterday and I wonder if he might
be about out of shares? It could also just be that he cannot sell his
shares below 1.71 I guess. Only time will tell but thought I would
bring this over. I am betting that if OLIE is about done and leaves
that we could move back up, hence my interest in this. Here is the
