Further to news in Stockwatch July 20, 1998, the board of directors advises that Trooper has received a package of documentation from Thermo Tech Technologies and Thermo Tech Waste Systems purporting to be full compliance with the order of Mr. Justice Cohen requiring delivery up to Trooper of all standard certified engineering specifications, including drawings, regarding thermophilic plants.
However, Trooper must report that what has been delivered by Thermo Tech fall far short of what is required by the order of Mr. Justice Cohen and again constitutes nothing more than some selected and edited specifications and drawings "created" by Thermo Tech subsequent to the order having been granted. By delivery of these materials, which did not even exist at the time of the order, and by non-delivery of all of the voluminous specifications and drawings which did exist at the time of the order, Thermo Tech has chosen to continue and, indeed, to magnify its flagrant contempt of court. Such a course of conduct obviously calls for the sternest measures to ensure that the court's orders are not willfully disobeyed. Trooper will shortly be instituting the appropriate proceedings to put a stop once and for all to Thermo Tech's obvious defiance of the order of the court. These proceedings will involve the imposition of the fine already ordered in the sum of $50,000 and application for new monetary penalties of much greater magnitude and an application for the committal to prison of those persons responsible for Thermo Tech's illegal actions.
