RobertS, you seem to be trying to make a connection between cost of administration of BPI and the price INCY was willing to sell its patents. I don't follow this. It seems you have a preconceived answer for your own question. Do you want to say BPI is not worth much and so INCY bailed cheap? If so just say it. Or you can check Cacaitos old post for detailed reasons why administration of NEUPREX, (if it works), would support a high unit cost because it would save other cost producing a net savings for the hospital, in addition to better outcome for the patient.

I thought RoberK also spelled out why INCY had a much weaker hand would choose the route it took. The FAQs of XOMA mention what we all knew. INCY had no trials underway or even planned for the BPI/LBP area.

BTW RobertS, does BPI work for gram positive bacteria?

RobertS, as you might have already guessed, people will smoke you out real quick on this thread. Now don't you suppose what Xoma gave for the license from INCY will buy you alot of lawyering even nowadays? If Xoma went head to head with INCY at trial, why would INCY even try to fight? Maybe because they think it was worth fighting for? Nobody knows for sure why they both decided to settle but I assure you if I thought like you did that INCY doesn't think much of BPI, well then why would Xoma make ANY deal with them? What irritates me though is that I am having to explain this to you when I know it doesn't fit your agenda. At some point in time you are going to have to come up with a full out assault on Xoma and you know, you might as well get on with it now.
