David, I agree with you. They ought to just let the courts straighten it out. That seems obvious to me to let the courts decide but their attorney probably would not want them to be posting here if they really have intentions of going to court.

I grew up in the adjacent town to Asbury Park...

And I heard last weekend that they were knocking down the Palace Amusement House. It was 100 years old. Bruce (I'm not a fan) put it in a couple of his videos... Broke my heart to hear it... Spent lots of time there as a kid...

David Hayes (In response to the IR stuff I may be able to contribute) I have been reading and trying to keep up... WHAT IS KZAP's POINT ANYMORE. He talks about not caring where the stock goes and two plays later he's implying things by discussing leading questions that he feels haven't been answered.

Okay, I talked to MM yesterday or the day before. Here is the deal. KZAP are you listening;

Without getting details fromm MM about the discussion he had with KZAP and not needing them in the first place, it is clear that what KZAP IS/WAS ASKING FOR IS ILLEAGAL. He can't know about corporate developments before they are announced through a proper disclosure medium... MM is an insider. By receiving a paycheck from CSMA he becomes a representative of the company and becomes PERSONALLY liable for acts of impropriety (ie- insider trading). So while it was wrong to do so, MM, by telling KZAP where to get off did right by us. Because he is not supposed to know anything first. No one is...

MM is in a difficult position. I know because a thousand KZAPs call me everyday thinking they can get over. And I can't let them know anything. No matter what tricks they pull, How they instigate me or how much they threaten me with going to the company to say that I'm not providing the service I'm paid for. It's all BS... And if I slip, If someone gets something out of me, And the persons affected can prove in court of law that shares were traded on said information. Guess who buys it... that's right, me.

In sum, KZAP is playing both ends against the middle and veiling it with "The company won't answer these questions". Read the safe harbor agreement printed at the end of the release. The statements are foward looking and subject to change. ITS YOUR RISK... They don't really have to answer anything. Not by law, not until a lawyer or the SEC comes forward to ask. So if you can't claim membership to one of the above that's it. Unless KZAP has a friend AT the SEC. But I think his friends are running for cover...
