The STB said something like:

Only 5% of freight rail traffic into NYC is from east of the Hudson so rail competition is not required. (??)

However CSX , make a deal with CN so they can compete if they want to.

But NYC is so congested no one can run more rail traffic into there anyway.

We won't mandate that NS and CSX increase use of Greenville. They both have access and if it is economically useful, they will use it.

Since CSX and CN will compete on the east and NS and CSX will compete on the west, the complaints in the anti-trust suit won't occur in the future.

STB has not handed NYCH any gifts. But, that isn't their job. It is in the best interests of NYCH, NY&A and NYC to increase rail traffic onto Long Island. Since there are 13 million people and little industry, it is upon consumer goods coming in by rail that the emphasis must be placed. The key elements are for the City to provide a distribution hub near Fresh Pond and to close the bridges and tunnels across the Hudson to the trucks either by heavy tolls or other restrictions. There is ample justification to do both, and then let the competition flourish. Many groups with economic needs must be satisfied also. It will be hard to accomplish.
