Ken,

If the error in the press release had been material, then I would agree with you that it would be cause for concern. However, there is absolutely and emphatically nothing material about the typo in the heading! You are carrying this WAY too far. In fact, it was so immaterial that I'd be willing to bet that nobody even cared or caught it! I would consider something material IF they only report 18 cents on July 30, which obviously is not significantly above the 17 cent estimate as was stated in the press release.

And I am replying to you that the error was innocuous to say the least and your charge is ridiculous.

Ken, you seem to be too obsessed with ZAP. There are less risky
stocks for you to short or buy puts on. ZAP has too much fundamentals
to be a good short. You must be a real masochist.

Good shorting elsewhere,
d.i.

Ken, I have a simple question. As you say "ZAP is cooking the books", and if the statement is without a sound basis in fact, then can't you be sued for libel if the company so choses ???? Just wondering. DJF
