I am confused. Naked short selling occurs all the time. If it occurred as a sale of "restricted" stock and that restricted stock is cancelled, the buyer of those shares can be made whole certainly by delivery of unrestricted stock.

Or is this point merely a count of alleged tort by the selller of that unregistered stock and not a covering issue.

Exactly! I think this is a likely senario... no legal action, and trying to cause fear to tank the price :-)
