According to the ABQ Journal the SEC has filed with the bankruptcy judge to not confirm to reorg plan. I would appear by the article that the SEC wants the removal of Rendall and Campbell. I do not know if the SEC has any standing in this matter, as they are not a creditor.

The filling is not available from the court clerk so I called the reporter (who plans on attending the hearing tomorrow). He indicated that the filing was sent to him directly from the SEC.

Previous ruling and appeal have gone against the SEC sharing trade secrets with foreign-based competitors. In the arguments presented in court the SEC stated they were not able to complete their investigation without their "experts". Wonder what they will tell the judge has changed that they now believe their criminal complaint should preclude a presumption of innocence.
