The Financial Post reports in its Wednesday, July 29, 1998, edition that Barrick Gold should be forced to answer for its role in the Bre-X Minerals fraud because it failed to warn investors of the "bombshell results" when it tested 135 core samples and 130 showed no gold, says a filing in a Texas-based class action lawsuit. The Post's Sandra Rubin writes that Barrick has asked it be dropped from the suit because it was conducting limited due diligence on Bre-X's Busang property and had no direct duty to Bre-X investors. Barrick has also said it was bound by confidentiality agreements. But lawyers behind the class action argue Barrick made statements aimed directly at Bre-X shareholders when it promised to be "fair" in any partnership deal to develop the Busang deposit, and that changes everything. The Texas filing says, once Barrick started making such statements targeted at Bre-X shareholders, it assumed an important duty; to make full and complete disclosure. Barrick violated that duty, lawyers say.

Alan: What a great article! That is definately a must read. I still can't get over the discrepancy on the amount of shares that traded during the week of March 21 (17,000,000) avg price of $16 for a value of some $275,000,000, and the events that led up to "insignificant gold>"... Barrick, Freeport and countless others knew prior to March 21 of the results...you've got to wonder what there trading history on the shares were.

Freeport-McMoRan Indonesia unit stalled

Reuters Story - August 11, 1998 20:21

NEW ORLEANS, Aug 11 (Reuters) - Freeport-McMoRan Copper &
Gold Inc. said Monday its Indonesian affiliate, P.T. Freeport
Indonesia, has temporarily suspended mining and milling
operations at its Grasberg complex in Indonesia as a result of
a wildcat work stoppage by a group of workers.
The company said in a statement that the voluntary
suspension of operations was done in an orderly fashion on
August 11 as a precautionary step to ensure the safety of
employees and to avoid the possibility of confrontation.
Although unorganized, the workers have cited economic and
other employment issues as the reasons for their work stoppage.
The actions of the workers have been peaceful and there have
been no injuries or property damage and the affiliate's port
operations are unaffected. Shipments of concentrates are being
made from inventory.
The affiliate is working with the Indonesian government
authorities and its work force to resolve the matter.
