I am not anything close to an expert on bankruptcy law. But, that having been said, I am certain that whatever effect the bankruptcy court's ruling may have on the SEC action against Solv, it will have no effect on any action against JR and HC.

Generally, anyone having a claim against a debtor has to assert that claim or lose it. I do not know whether the SEC action is governed by the general rule or whether it fits into an exception....someone else will have to answer that question....

I wonder what happens to the bankruptcy court's injunction once the bankruptcy is complete? Does it survive or must the SEC and Solv begin the fight over confidentiality anew? I suspect that it depends on whether it was a temporary or permanant injunction. But again, there could be rules peculiar to bankruptcy that could affect it: it wouldn't surprise me.
