Charles, Arizona is a relatively friendly permit state. The air quality permit for a Maxam type operation is fairly straight forward. You get the form fill in the blanks and mail to Maricopa County. They review and if everything is in order, they give the public 30 days for comment. If no significant comments are received they issue the permit. The Maxam permit for Maricopa County has been ready for about one month but no one came by with $350 to pick it up. They mailed it to Maxam but it won't take affect until they receive $350. After Maxam starts up, they probably won't inspect unless there are complaints. The water quality permit was conditioned on performance. Therefore there will probably be inspections and Maxam will be required to document performance. Here again if there are complaints or spills or leaks, these could initiate special inspections. There is no permit required for the Mine Safety and Health Administration. However, the operator must apply for a federal ID no. with MSHA. The operator must then file a training plan with MSHA. After the training plan is approved, all mine and mill employees must be trained under the plan. Training is a minimum of 24 hours unless they have been trained before and then they must have an 8 hour refresher. All employees must also have an 8 hour annual refresher. Once operations start, MSHA will make two annual random inspections for health, safety and training compliance. It is my understanding that BLM determined that Maxam could not operate their operation on a five acre exemption. Maxam then filed a mining plan for a full blown operation. The BLM has rejected their mining plan on the basis that their are inadequate reserves to support such an operation. I believe that Maxam is working to resolve this problem. I have not confirmed this personally but I have been told this by two sources who said they have confirmed this personally. Once operations start, the BLM will inspect on some regular basis to determine that Maxam is in compliance with operating plan and that reclamation is proceeding accordingly. There is no record of an air quality permit application in Pima County for Maxam, Runyon, Kilborne, Cimetta or Hewlitt. This has been verified personally by myself and several others, one of whom claims to be a Maxam shareholder. Tim Hall
