NDA's are NDA's. If you violate them you can be sued, if it is blatant, or is deemed to have caused damage to another company, you will be sued, it is as simple as that.

You are allowed to talk about your own products all you like, but can you imagine a press release like: "Boy, we really saw Vixel's hubs mess up under a full load!" Like I said, the goal of the FCA is to unify and have a complete set of standards and a complete set of products that conform to those standards. The NDA's covering testing is in place to make everyone feel safe participating, even if their product isn't fully compliant in one area or another. Why would any company participate if there was a chance that by showing up their products deficiencies would wind up in a competitor's press release?

You could certainly have an independent lab test the switches and publish a report, and I'm certain that will eventually happen, but it is sort of subjective since both the Silkworm and MKII are still evolving - where do you draw the line and what versions of each switch do you compare?

The NDA excuse is old, but unfortunately it is accurate. You cannot violate them simply because you are not getting paid.

You can choose to be patient a little longer or throw in the towel. I believe there is way too much money to be made in FC SANs for Ancor to be forsaken. They will need help, but they will survive - dare I say flourish?

Iceburg securities strongly recommends not selling at this price ;-)
