KHS, In all fairness to Vivus. IF they are at a serious level of negotiations then they are best off being as tight lipped about it until the papers are signed. Premature devulgence of such matters has been known to ruin many a potential deal. If Vivus says nothing because they have nothing then that is one scenario that they should fess up to but if they have something serious in the works then let them close the deal ASAP and then let us know what is going down.

KHS, You make a good point regarding the institutions who still hold over 40% interest in Vivus. They certainly do not want to sit on dead money until the end of the year. Vivus needs to answer to the institutional and individual investor. The sooner the better.
