- Could be:

1. Section 144 restricted stock that can't be sold until some point in the future

2. ESOP stock that can't readily be sold

3. Or some other stock socked away by an affiliate or someone else that is not available for sale at the present time.

4. It can't be stock that Vivus itself is holding - as that would be "treasury stock."

5. Might be a good question for nina.

6. And finally - yes - I'm still holding my shares. But until a US-deal is reached. Either a buyout, co-marketing, or something, I'm trying not to watch the stock on a daily basis.
