For what it is worth, after the deadline is missed, the claims become open. The notice is a procedural process whereby the BLM removes the claims from their books. If a company misses the deadline by accident, and they want to hold the claims, they have to refile and go through the whole process as if they were new claims. It is not acceptal to pay the maintenance fee between Sept 1 and when the official notice is received.

I asked the question of the BLM, what if a company does not renew their claims on Aug 31 and I file on the same claims Sept. 1. The BLM said I would get the claims. I also asked what if the other company came back and filed on the claims Sept. 2. The BLM said they would take both of our money but would not get involved in ownership, that would have to be settled in a criminal court. I know it does not make much sense but since when has any government agency been required to make sense.
