You will have to look to countries such as Germany to find a separate court system called "The Patent Court".

This is from the United States Patent Office site, under the title of "Infringement of Patents"

"Suits for infringement of patents follow the rules of procedure of the Federal courts. From the decision of the district court, there is an appeal to the Court of Appeals for the Federal Circuit. The Supreme Court may thereafter take a case by writ of certiorari. If the United States Government infringes a patent, the patentee has a remedy for damages in the United States Court of Federal Claims. The Government may use any patented invention without permission of the patentee, but the patentee is entitled to obtain compensation for the use by or for the Government."

This is exactly the process that the Fonar case followed. If you are using the two "experts" as sources, I certainly hope that you attempt to verify anything and everything else you've been told.

Hi, Dr. F. All I know for sure is that the proper legal forum to recover damages resulting from the theft of intellectual property is CIVIL COURT!

I am less certain about the function of a Patent Court, but I would hazard a guess that they could assess the legitimacy of a patent claim but with no mandate to impose damages for unauthorized use. I'm sure Zeev Hed would know more about this.
