This was pointed out in a previous message and if I were long I would be concerned:

"America Online on Tuesday did not report net income for the fourth quarter as it is finalizing one-time charges from the shareholder lawsuit and write-offs from its acquisitions of Mirabilis Ltd. and NetChannel Inc., it said.

The company is consulting with the Securities and Exchange Commission on its accounting of the acquisitions, and Chief Financial Officer Michael Kelly told analysts the company expects to post a $17 million to $18 million charge against fourth-quarter earnings to cover its share of the settlement."

So how is it that they can report meaningful earnings per share? $17 or 18 million will translate into almost $0.08/share.
