Re: Buying 500 shares after selling 1000 shares within the Wash sale rule window.

Pub 555 says that only 500 shares are subjected to the W.S. rule, and you can claim the loss of the other remaining 500 shares.

You NEVER loose your loss, it's just postponed.
buy 1000 @ $36
sell 1000 @ $28 (8/share loss)
wash sale buy 500 @ $18

This year you get to take a loss of only 500 X $8 = $4000 but the basis for the 500 you hold is not $18, it's $26 (the $18 you paid plus the $8 wash sale deferred loss). So, when you finally sell that 500, for tax purposes you "paid" $26 for them, not $18.
