I haven't read the entire brief yet, but the understanding I have
so far is that the defendants are contending that E-Data had it's
shot in court, that the court narrowly interpreted E-Data's claims
(correctly, they argue), and that now E-Data is attempting to
introduce new facts that should have been introduced in the original
brief, and as such, are not relevant to the appeal of the facts
previously presented.

If I'm getting it, the defendants are arguing that E-Data can't
relaunch its brief, even with new attorneys, and that arguments can
only be made based on the previous brief submitted by Mr Fink and
the court's treatment of it.
