J,
I don't know for sure if we have a definite answer as to exactly how many shares Whyteburg can sell each month. We may have seen Hart Properties shares cross the tape over the last few days.

Jewel, The majority of my sources indicate that Whyteburg can only sell about 60K/month as you mentioned, however if you read the 13D filing for Whyteburg filed on May 6, 1998, it clearly says under Item 6:

There are no contracts, arrangements or understandings between Whyteburg and the issue other that a subscription Agreement between DCTC and Whyteburg, dated 29 May 1997, pursuant to which Whyteburg may sell only twenty percent (20%) of it's holdings in any two-month period, commencing Feb. 1, 1998 and concluding Feb. 1 1999.

This would indicate that Whyteburg could actually sell 159,554 on the first month and I assume on a declining basis as it's holdings were reduced. There may be another restriction however that limits Whyteburgs sales to the 61K/month and this is the number I have been hearing from what I consider good sources. If we work this problem backwards knowing that Whyteburg sold a total of 508,125 to June 11th (see post 7533 for more details), then take out the original 162,600 shares that were given the Whyteburg account as part of the conversion from CC shares. (I am assuming that since those shares were apparently available "up front" that they were not a part of the 13D filing and were sold earlier) We end up with 345,525 shares sold. Since the 13D commenced Feb. 1 and the total sold was through June 11th, or 5 months + which would work out to right at 69,000 shares sold per month.

Now to your actual question. (G) The trading last Friday afternoon when NITE stepped on us involved a lot more than 69K shares being sold, probably closer to 150K, though I have not added those sells up exactly and I am not sure it's even possible. Yes, it's possible that Whyteburg may have finished their selling for the month and as Joe mentioned Hart Properties had a 144 filing for 40K shares and may have sold some as well which would account for some of the additional inventory that NITE had but not all. At this point, we will just have to see, there is just no telling for sure how many possible sellers we have out there, but if your hunch is correct that the selling could be done for the month I am sure we will be seeing it in our stocks price, as it always moves up when the overhead comes off.

I can tell you that I firmly believe that our stock is worth a lot more than $1.956 if that helps. (G)
