Larry, You reached your conclusion (question?) without the necessary variables. 1) Was the information material & non-public? Well in this case I would say yes, but with CLST's track record not necessarily. But lets assume it was. 2) Was the information based upon the Mosaic Theory? As I am sure you have no clue what that means I will try to explain. If someone receives non-material non-public information & combines this info with publicly available or non-material info-related discussions with employees/industry professionals, then any conclusions that you reach are NOT considered inside info. This post is based off of the Ethics portion of the CFA exam, which you are free to take.
