My read on the government's right to use the tapes is sure they can: the exclusionary rule only applies to information illegally obtained by the government; if they are given information, they can freely use it even if it was illegally obtained, since the purpose of the exclusionary rule is to deter improper government behavior. I haven't gone back to my CrimPro books to check this, and the issue has never come up in any of my cases (I don't do that much criminal work), but this is what I recall.
