The article doesn't quite have it right, but what it expresses is bearish for DSL. The FCC is discouraging exactly what they claim they are encouraging. That's what government regulation always entails. This is consistent with the nonsensical Telcom Act of '96.

The implied ruling will give the RBOCs further disincentive to make infrastructure investment. They would have to set up an affiliate which is just as constrained as they are with the only advantage allowed is in relaxing the requirement to provide discounted broadband services. This puts further pressure on local telephone operators to incorporate cable access within their areas. Specifically, that means they have to look for appropriately positioned cable companies and buy or merge with them.
