Dr. Risk,

You have posted many times about the actions of RMCC, which I understand to be a NASDAQ MM in the AIPN stock.

Please explain why you think that the actions of RMCC or any other NASDAQ MM indicates any sort of "accumulation" by that MM. Your statement - "FWIW the recent accumulation of AIPN stock down from $1.50 and up from the low of $1.00 has been impressively staged by MM's who have been historically accurate when it comes to bottoms in this stock." - would seem to indicate that the buys and sells are for the MM and not for any client.

How do you know this? What do you see on Level II or any other trading system that would tell you this? Am I misinterpreting your statements?

A NASDAQ MM is forced to make a market for any stock that they represent or else leave. That means that they must buy and sell stock. So ????

Any instructive comments would be appreciated.

My thoughts on this offering.......

Despite my genuine interest in seeing the convertibles being eliminated I find this new financing offering disturbing. These 'junk' bonds will be outstanding for 5 1/2 years at 12% interest. Not to mention that they have 2.5 million warrants attached with a strike at 1 1/2 bucks. Oh great.....lets see....the company will be paying 6 million in interest annually. Damn....there goes most of the current refinery profits right? What is the best case scenario for sales and net profits going forward for the refinery? I don't doubt that this offering will fly but it seems to me that it will be a long while before the company will have retained earnings. So the company has 12.5 million earmarked for Kazahkstan......is that enough to make it happen? They better be damn lucky on the first few holes I would think. Then ....even if they hit it.....there still exists the problem of transportation.

The company plans on spending 18.5 million on the Lake Charles refinery. For what? Seems to me the refinery will not be up to capacity without some major improvements. Leads me to wonder what the current operating capacity is now. I thought the Florida refinery needed more work than Lake Charles. Hummm....at least we have something to discuss for a while.
