I think that a well documented series of internal memos that document not only this but other projects where the internal development and the public PR were at odds would be pretty convincing. When a company sets internal strategy and deploys resources, that's a real dollar commitment. People tend to distrust PR anyway. I think that would be an easy case to make if the internal documentation is there.

Mike, The DOJ can't have it both ways. If they are using email records, that are perhaps out of context, to prove their case that Microsoft was going to "kill Netscape", then Microsoft should be able to use email to counter them.

Maybe its a wash.
