Datek sometimes does this kind of sneaky thing. Once my day order was executed at 4:25pmEDT right after some after-market news hit the wire. Usually day order should be automatically cancelled by then.

I've had an order or two executed a few minutes before the open. These were limit orders. I think it's legal for other traders to take out your limit order before the open, but I just don't know who can do this.
