They being ALL who were involved with this stock from the first place.
From MTEI to ICVI down to "Joe's Garage"

Jack Uselton may be a good guy, but that does not put the money back in my pocket.

If you can, hold on for the suit. If you sell now you can not be involved and they know this.

In any case, LH's statement is inaccurate. Doesn't matter whether you've sold or not; only whether you owned the stock during the critical period, and have lost money.
