Ultimately, if this latest victory by the tobacco industry gets appealed to the Supreme Court, the tobacco industry will win easily. Justices Scalia, Rehnquist, Thomas, Souter, O'Conner and Kennedy have a very strong conservative history of upholding the law and supporting Corporate America. Justices Ginsberg, Stevens and Breyer are more liberal in orientation and would probably dissent here.
The Federal Government is beginning to flip out here ( having been left out in the cold ) and is seriously considering filing their own 1 trillion dollar lawsuit against the tobacco industry. If its filed, I would expect some downside pressure on MO's share price. Ultimately, however, I think their case is bogus and would get thrown out, like all the other class action law suits. The whole point to the filing of the law suit is to get the industry back to a comprehensive national settlement and away from the present negotiations with the Attorney Generals. I would buy even more MO on this weakness if it comes to pass.
