Sticking fulfillment under marketing has got to be grounds for a legal action once
the stock tanks - there can't be any possible explanation under GAAP.

I agree. The placement of fulfillment expenses in marketing is disclosed in the 10Qs and 10Ks but most people do not reading those forms piror to investing. Their is an assumption by investors that GAAP is used by the company in which they are investing.
