Good question. I don't know. Maybe one of the others here can contribute and call Vivus and find out. Question is whether or not the court believes the suit has any merit. If no merit is found then the suit will be thrown out. If merit is found then a court date will be set. Vivus may actually settle for a small amount if court costs are thought to be higher. It will be the insurance companies (not Vivus managements) decision.

In the last few weeks I received lawsuit settlement information on 2 stocks I once owned. Both stocks saw sharper declines than Vivus. In both cases a settlement was reached for less than $1.00/share. Relatively speaking the share holders get close to nothing but the lawyers as always make out like a bandit because they get 1/3 of the settlement for merely filing the appropriate papers and recruiting as many clients as possible.

In both cases (as usual) the lawyers settled out of court because a settlement in their favor if a trial occurred was not guaranteed and if they went to trial they probably would lose and get nothing. Just proves that the lawyers always make a killing when a stock drops by simply signing up as many clients as possible.
