Can you also identify situations in which it never occurs?

No. As I stated earlier, it seems somewhat random.

Do you have any ideas as to why it does occur with greater frequency before 10am on fast moving stocks?

Probably just the tremendous volume that occurs all at once, first thing in the morning. Their order routing system just can't handle it. However, as I've stated, I haven't seen this problem lately. Maybe its fixed. Also, few problems have been reported on the main Datek thread recently. This is a good sign.

One simple test anyone can do, is find a stock ready to move sharply at the opening bell (news related usually). Simply post a limit order away from the spread and see if it immediately shows up on ISLD. You don't need Level II for this, just the ISLD viewer at isld.com

If your order shows up there immediately, things will probably be ok.
