I love that expression - voluntarily. It just doesn't seem right that this testimony could be called voluntary. However, I heard a talking head say the same thing last night. Thanks for the correction. Funny thing - if I volunteer to be a witness in a criminal case, and I refuse to answer a question put to me by one of the attorneys, I guarantee the judge will give me the choice of answering or being found in contempt. I don't believe the presence or lack of a subpoena would matter.
