correct me if I am wrong, but doesn't the 10 k say that vvus does not believe it will return to profitablility in 1998?

Funny how the longs can read that one way and the shorts another, isn't it? I read it the same way you do Mike. In my opinion, if they thought they might make some money the last 2 quarters, but not enough to break even for the whole year, it would have said, "...does not believe it will return to profitability for 1998." Since they said, "profitability in 1998" it is my opinion, as it would seem to be yours, that they will lose money in the 3rd and 4th quarters as well.

Plus, my wife has still yet to fill a script for MUSE since V was available. Yes, I see they are selling some MUSE, but enough to make profits? Doubtful.

You and John are obviously correct in your interpretation of the 10-K. It states that Vivus will NOT return to profitability for the rest of 1998.

Although this is bitter to swallow for many Vivus longs, IMO this company will see 3 before it sees 15 again.

Mike,

I spoke on the phone today to a friend who spoke to management about the filings amongst other things. It is the lawyers, not Vivus who drafts these statements and the wording is designed to paint the worst possible outcome. At present, the company expects to see break even to a small profit in Q3 and a significant profit in Q4. I agree however that as read it sounds as if the company will not make a profit for the rest of the year. After being sued and accused of making bullish statements to mislead investors, I believe that the wording in the filing is appropriate to prevent further lawsuits.
