Clinical status is determined on a drug by drug basis.

In a preclinical stage the company is proving that it works. Once they've finished testing a specific item, it's not in a preclinical stage any more. It could be useless - research to be discontinued. It could be a potential for an IND, which may not actually happen due to various reasons eg available cash, company strategic decisions etc. It may have an IND generated and be rejected. All these cases are neither in preclinical or clinical stages.

Clinical trial status is only gained by an approved IND. That's my understanding.

re FDA, you might be right - I don't know.
