Your quoted article merely says that Exponential filed patents before Intel filed Merced-specific patents. That is all it says. The rest is total speculation on the part of the author. In fact there is no claim that the author even knows anything about the content of either patents.

There are only two countries in the world which are first to invent and not first to file. The two are, the United States and the Phillapenes(Not sure, though). If this is the case, both parties Intel and the current owner (S3) will have to prove that they invented first.
