As Martin stated, the rule is 30 days. You can buy prior to 30, but I believe the loss is essentially delayed until you unload the new shares. As to the capital gains rate, Clinton has signed the bill changing it back to a single 12 month category for long term capital gains, effective back to January 1,1998....
