Legality' only is a question when the short was undeclared or naked. MM's supposedly have the freedom to keep a market liquid. The problem in the AZNT market is that illegally obtained shares were sold into the float.

"Naked shorting" doesn't create actual "new" shares. Nor are the shares in question "obtained". They are simply invented. And people who do short naked don't hold their positions for very long, for obvious reasons: three day settlement, and all that.

Sooooo...if "extra" shares have been entered the market, I'm afraid we'll have to look elsewhere. Just let me guess...
