Marshall-- Thank you for scanning and posting the Data Race vs. LU filings. I just scan-read them and if the claim is correct, it looks like rape and pillage to me. I am not a lawyer ;-))

Marshall: This sounds a lot like the situation that erupted with Ciena's DWDM being tested by AT&T. Ciena has a 16 channel and 40 channel system ready to sell. Then, BANG! Lucent announced a soon to be marketed 80 channel system. While the initial impact of lost sales to AT&T upset the TELLAB/CIENA deal, the more far reaching impact is that other potential customers will wait for Lucent greater capacity system. As a shareholder of Lucent, my concern is that too many dead bodies lying around may come back to bite them in the ARSE. Legal entanglements can become a real drain if LU has too many claims going at once. Worst yet, What if the anti-trust folks get involved? OUCH! Regards, Bob S.
